Terms of Service — Cry Translate

These Terms of Service ("Terms") govern your use of the Cry Translate mobile app for iOS and Android (the "App"), operated by Attention AI (Thailand) Co., Ltd. ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

Cry Translate is not a medical device and does not provide medical advice. The App's cry interpretations are probabilistic suggestions produced by a machine-learning model, offered as a parenting aid only. They are not a diagnosis, and they can be wrong. Never use the App as a substitute for professional medical judgment. If you are concerned about your baby's health, safety, or wellbeing — including persistent or unusual crying — contact your pediatrician or emergency services immediately.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the applicable app store's rules.

2. Free tier

The App's free tier includes up to 3 cry analyses per calendar day, counted on your device and reset at midnight local time. We may adjust the free allowance in future versions of the App.

3. Subscriptions and purchases

"Cry Translate Plus" removes the daily analysis limit. It is available as:

an auto-renewing monthly subscription (US $1.99/month),
an auto-renewing yearly subscription (US $9.99/year), or
a one-time lifetime purchase (US $19.99).

Prices are set in your local currency by the app store and may vary; the price shown at checkout is the one that applies.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
You can manage or cancel a subscription at any time in your App Store or Google Play account settings. Uninstalling the App does not cancel a subscription.
Refunds are handled by Apple or Google under their respective policies; we cannot issue refunds directly.
Use "Restore Purchases" in the App to re-activate Plus on a new or reinstalled device using the same store account.
The lifetime purchase is a one-time payment granting Plus for the supported lifetime of the App; it is not a guarantee that the App will be maintained indefinitely.

4. Optional cry donations

You may optionally share cry recordings to help improve the App's model, as described in the Privacy Policy. Donations are voluntary, anonymous, and — once sent — cannot be retrieved or deleted. By sharing a recording you confirm you are the baby's parent or legal guardian (or have their permission) and you grant us the right to use the anonymous recording to develop and improve our machine-learning models.

5. Acceptable use

You agree not to:

use the App for any unlawful purpose, or to record any person without a lawful basis to do so;
reverse engineer, decompile, or extract the App's machine-learning models, except where such restriction is prohibited by law;
circumvent the free-tier limit or purchase verification;
resell, rent, or offer the App's functionality as a service to third parties;
submit deliberately misleading donation data intended to degrade the model.

6. Intellectual property

The App, including its software, models, design, and content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights other than the license in section 1.

7. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. We do not warrant that cry interpretations are correct, that the App will be uninterrupted or error-free, or that it is suitable for any particular baby or situation.

8. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on the App's suggestions. Our total aggregate liability for all claims relating to the App shall not exceed the amount you paid us for the App in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under Thai consumer-protection law or, where applicable, the consumer laws of your country of residence.

9. Termination

You may stop using the App at any time. We may suspend or terminate your license if you materially breach these Terms. Sections 4 and 6–11 survive termination.

10. Changes to these Terms

We may update these Terms from time to time. The current version is always available at this address with its effective date. Material changes will be communicated in the App or via the app store listing; continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law rules. If you are a consumer in a jurisdiction whose law grants you mandatory protections or a mandatory forum, those protections are unaffected.
